I totally agree with you here, could not have said it better.
There's a difference between PVP and PK, if the person fights back it's PvP, when someone at cap level hangs out in a beginner area killing lowbies is PKing. There's an absolute 0 chance of doing anything about it.
There's one thing when someone around my level trying to kill me I'll just fight back, but when someone is high enough to one shot me the moment I step outside of town every single time without any repercussion is something different altogether.
Penalties exist to keep people in check, It's like you know, real life? You can still kill people but you'll have to accept the price. I get that you get your jollies from killing lowbies cause you simply get your fudge packed by anyone your level. But, nothing comes without their consequences, it's a good life lesson that kids need to learn.
I see some penalties more as a reward, it also adds to excitement. Like if the pker drop gear, it's a reward for head hunters. If you're the one pking it makes you feel like a fugitive, you run, you run for dear life when multiple people come after you, it gets really exciting, your heart race you giggle in joy and disbelief when you survive somehow. I know I've been there several times.
It's nothing to do with restriction, it makes you THINK before you act.
